1. Scope of Application of the GTC
noosh.studio shall provide all deliveries and services on the basis of these GTC. The General Terms and Conditions apply to all orders placed in our e-shop, but not to orders and purchases made through our resellers, at fairs, pop-up events, or in any of our sales premises.
2. Offer and Conclusion of Contract
Our prices are quoted in Swiss francs (CHF), and shipping costs are not included in the prices. If shipping costs are charged, they will be shown separately when the order is placed at checkout. Prices may change at any time due to economic circumstances, such as fluctuations in raw material costs, but changes will only apply to future orders. Obviously incorrect prices are not binding for noosh.studio.
Our e-shop assortment is continuously updated. However, there is a possibility that certain items, although listed in the e-shop, may no longer be available. If an item is no longer available, the customer will be informed by email, and any payments made for that item will be refunded.
The purchase contract is concluded with the acceptance of the order by noosh.studio, which occurs when an order confirmation email is sent to the customer.
3. Order and Payment
Orders can only be placed via the online ordering system of our e-shop. Orders placed by telephone, fax, email, or social media messages cannot be considered.
In general, orders are shipped with Die Post Switzerland. In-person pickups are available but only if the customer selects the pick-up option at checkout. Pick-up is currently available in Bern, and for additional pick-up locations, please check the wholesale and pick-up locations listed on our website.
noosh.studio accepts the following payment methods: Visa, MasterCard, Amex, PayPal, and Apple Pay. Payment is always processed at checkout, including for pre-orders. These payment options may be updated; please check the options available at checkout.
4. Shipping Costs
Customers can choose between Die Post Priority and Die Post Economy for shipping within Switzerland. Shipping costs are calculated based on the weight and destination of the order and will be displayed at checkout. These costs include all packaging fees but do not cover customs duties or additional costs for shipments outside Switzerland, which are the customer’s responsibility.
5. Delivery Periods
All candles are made to order. Please allow 3-5 business days for your order to be dispatched, with an additional 1-2 business days for shipping within Switzerland. International shipping times may vary based on the destination and customs clearance.
While we strive to meet the specified delivery times, please understand that delays may occur. If you do not receive your order within the estimated timeframe, please contact us at hello@noosh.studio.
6. Goods Inspection
The goods travel at the risk of the recipient. Transport damage must be reported to the post office immediately to assert claims. Any complaints regarding missing or damaged items must be reported to us via email at hello@noosh.studio within 5 business days of receipt. Always take pictures of the damages and send them to us; we will strive to find the best solution.
All returns are at the expense of the buyer unless the product arrived damaged. In such cases, return shipping costs will be covered by noosh.studio.
7. Returns Policy
For damages that occurred during shipping, returns will be covered by noosh.studio. However, if the customer wishes to exchange the product due to personal preference, return costs will be at the customer's expense.
8. Sample Sales
Sample sales include candles with minor defects, mismatched colors, dents, or frosting. These items are clearly declared as such in our webshop and are only available in limited quantities. Please read the product description carefully for more details on the condition of each sample sale product. Returns will not be accepted for any defects clearly declared in the product description of sample sale items.
9. Custom Products
Refunds do not apply to custom products, as they are specifically made for your order.
10. Exchange Policy
Our products can be exchanged for other items from noosh.studio. Please always contact us first via email at hello@noosh.studio before attempting an exchange. The product must be sent back to us in flawless, unused condition. Once the exchange is approved, we will issue a voucher, which can be used to purchase another product from our webshop.
11. Liability
noosh.studio shall not be liable for any damages resulting from the use of the products purchased, especially in cases of improper use. Claims for damages due to delivery delays, incorrect deliveries, defective goods, or any consequential damage from using the products are excluded unless there is grossly negligent or willful misconduct. We strongly advise customers to read the information on the product label or enclosed "Candle Care" guide to avoid improper handling.
12. Data Protection / Security
noosh.studio stores only the customer data necessary for business transactions and uses this data exclusively for this purpose. All customer data will be treated confidentially in accordance with data protection legislation and will be stored for the standard duration required by law. We work with third-party payment providers that also adhere to data protection laws. No customer data will be passed on to third parties.
13. Communication
All out-of-stock items are clearly indicated as such in our webshop. Pre-orders are also declared, and relevant information is provided in the product description. If any delays occur on our part, we will communicate this to the customer via email.
14. Retention of Title
The goods remain the property of noosh.studio until full payment has been received.
15. Place of Jurisdiction
Our business activities are governed exclusively by Swiss law, even for international customers. The place of jurisdiction is Bern, Switzerland.
16. General
By submitting an order to noosh.studio, the customer confirms that they have read, understood, and accepted the General Terms and Conditions.
